I know this thread has a bit of age, but I thought I would contribute some very current information based on an actual situation I have been involved in. It in essence clarifies the minimum expectation of due diligence placed on the seller of a RIF.
My situation I recently sold a glock17, to a buyer on another platform. He has been around for a while, and I had no doubts that he is a legit airsofter, I’ve sold him a few things over the years.
The package appears to have been stolen in transit, buy a postal/courier employee. However GMP’s finest were on the ball and discovered the package in a car being searched in connection with another matter, The packaging had been opened, and the G17 removed (to the waistband of the driver apparantly). The packaging including buyers address and (senders address (mine) was recovered in the car.
I was visited by local Police, and asked about the sale. They made quite a fuss about me posting a replica firearm, which I had to point out was actually legal. (PS I want to make it perfectly clear they were professional, polite, and knowledgeable about Airsoft)
They asked me what steps I had taken to ensure that the buyer was entitled to buy. They asked me if I could produce evidence to support my claims that i had taken those steps.
I explained that in a previous sale I had simply asked the buyer if he was over 18, and that he said yes. I was able to show a messenger chat, from 3 years before where I had asked that question. I did not ask for any proof of age.
I then went on to explain that I knew he was a current skirmisher, so I didn’t feel that I needed to specifically ask that question in relation to every sale. I explained that I was satisfied that the buyer understood the law, and that he would only use the G17 at an insured site. I showed the police the chat history with this guy in which we had spoken about performance at game days of various recent purchases.
On the face of it they accepted that I had complied with the minimum expected enquiries to meet the required due diligence
They suggested, and I think I agree, for each sale you should ask 2 questions of the buyer,
Are you over 18?
Can you confirm that you intend to use this RIF at an insured Airsoft site?
They agreed that there was no need to gather evidence to verify the answers and that asking the question, and noting the reply was enough.
